2.1 Candidates
The type of information that we generally collect and hold about candidates is that which is necessary to assess suitability for placement, work availability and eligibility; or to manage performance in work obtained through us. This includes:
· General contact and identification details (e.g. name, address, phone number and email address);
· Information about your education, work history, qualifications and skills;
· Information about your career aspirations and preferences;
· Information about your work rights and eligibility within Australia;
· Information about your personality and character;
· Sensitive Information (e.g. information about your health, medical history, criminal record and ability to undertake specific types of work), which will only be collected with your consent;
· Construction-specific credentials including White Card, professional engineering licences, builder's licences and other industry accreditations;
· Identity documents including passport, driver's licence and visa documentation, which will only be collected where necessary and with your consent;
· Information about past work performance; and
· Your tax file number and other relevant bank and superannuation account details, where relevant to the placement.
2.2 Clients
The type of information that we generally collect and hold about clients is information that is necessary to help us manage the presentation and delivery of our services. This includes:
· General contact and identification details (e.g. name, address, phone number and email address);
· Information about current and previous employment;
· Information about team structures, roles and incidents within the workplace;
· Information about your business address, ABN and key personnel contact details;
· Your opinion of prospective potential and/or successfully placed candidates; and
· Your opinion of Align Infrastructure's services.
2.3 Referees
The type of information that we generally collect and hold about referees is information that is necessary to help us make determinations about the suitability of one of our candidates for particular roles or types of work. This includes:
· General contact and identification details (e.g. name, address, email address and phone number);
· Information about your current and past employment; and
· Your opinion of prospective and/or successfully placed candidates.
3. Purpose of Collecting Personal Information
The purpose for which we collect, hold, use and disclose your personal information is likely to differ depending on whether you are a Candidate, Client or Referee. Please also see our policy on Direct Marketing and Overseas Disclosures below.
3.1 Candidates
The personal information that we collect, hold, use and disclose about candidates is typically used for:
· Work placement operations;
· Recruitment functions;
· Workplace health and safety; and
· Statistical purposes and statutory compliance requirements.
3.2 Clients
The personal information that we collect, hold, use and disclose about clients is typically used for:
· Client and business relationship management;
· Recruitment functions;
· Review of workplace operations and health and safety management;
· Marketing services to you; and
· Statistical purposes and statutory compliance requirements.
3.3 Referees
The personal information that we collect, hold, use and disclose about referees is typically used for:

4. How Personal Information is Collected
The method by which personal information is collected is likely to differ depending on whether you are a Candidate, Client or Referee. We may collect information from third parties and publicly available sources where it is reasonably necessary to perform a specific recruitment function.
4.1 Candidates
Personal information will be collected from you directly when you communicate with us that you are seeking our services. Personal information may be collected when:
· You submit an application form or resume through our website or a third-party website;
· We communicate or interview in person, over the phone or by video conference;
· We receive reference checks from previous or current employers, work colleagues or professional associations (sought only with your consent);
· We receive medical records or criminal history checks (sought only with your consent);
· We receive a complaint from or about you in the workplace; or
· We receive information about any insurance investigation, litigation, registration or professional disciplinary matter in which you were or are involved during, or in connection with, a work placement.
We may also collect personal information from publicly available sources including the internet and social media platforms such as LinkedIn. When we collect personal information from public sources, we will manage it in accordance with the Australian Privacy Principles and this Privacy Policy.
4.2 Clients
Personal information may be collected from clients when you provide it to us for recruitment purposes. We may also collect personal information from publicly available sources including the internet and social media websites.
4.3 Referees
Personal information may be collected from referees when we are conducting candidate reference checks. We may also collect personal information from publicly available sources including the internet and social media websites.
4.4 Electronic Communication Tools
We may collect personal information via electronic communications tools, including when you:
· Request to receive emails or job vacancy notifications;
· Submit a resume by email or through our website; or
· Communicate with us via phone, email or social media.

4.5 Photographs and Identity Documents
We may request copies of identity documents (e.g. passport, driver's licence, visa documentation) where it is necessary to do so and with your full consent. This material will only be requested where necessary to perform recruitment operations. Where you request removal of your identity documents from our records, we will ensure they are securely destroyed.
5. How Personal Information is Held
Personal information is held securely using Microsoft OneDrive/SharePoint and our recruitment CRM system (Giighire and Loxo). We will store personal information for use or disclosure towards any recruitment purpose where it is necessary to do so. We will ensure your personal information is protected against misuse, interference, loss, and unauthorised access, modification or disclosure. Personal information will be de-identified or destroyed when it is no longer needed for any purpose for which it may be used or disclosed. See data management policies and procedures.
5.1 Information Security
Personal information held in our systems is protected using multi-factor authentication and access controls. Only authorised staff members may access personal information. We take all reasonable steps to ensure the information provided to us remains secure and confidential.
6. Disclosure
Personal information may be disclosed for any purpose for which it is held or for a related purpose where lawfully permitted. Disclosure may occur for internal operations, with clients to fill job vacancies, or with referees for suitability and screening purposes.
6.1 Related Purpose Disclosure
We may also disclose personal information for a related purpose. Disclosure to contracted service suppliers may include IT suppliers (including our CRM provider Giighire, Loxo and Microsoft as provider of OneDrive/SharePoint) and background checking agencies. We will take reasonable steps to ensure the privacy of your personal information when engaging third-party service providers.
6.2 Overseas Disclosure
Personal information may be disclosed to overseas recipients for recruitment purposes only. Our CRM provider and other third-party platforms may store data on servers located outside of Australia. Where personal information is disclosed to overseas recipients, we will take reasonable steps to ensure the recipient handles your information in a manner consistent with the Australian Privacy Principles.
7. Proactive Outreach and LinkedIn
Where we proactively contact candidates or clients via LinkedIn or other platforms, we will notify you at or before the time of collection (or as soon as practicable after) of the matters required under Australian Privacy Principle 5. This notification will include who we are, why we have your information, how it will be used, and how you may access, correct or request deletion of your information.
8. Access, Correction and Deletion
Subject to exceptions set out in privacy law, you can gain access to the personal information that we hold about you. For any requests for access, correction or deletion, we will first verify your identity. If you seek to access your personal information, please contact us and we will arrange its provision. If you discover that personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it. You may also request deletion of your personal information where we no longer have a legitimate need to hold it.
We will endeavour to respond and resolve all access, correction and deletion requests within 10 business days.
9. Complaints
If you would like to make a complaint about the handling of your personal information, we request it be done in writing. You have the right to complain if you believe we have interfered with your privacy. We will acknowledge your complaint within 5 business days and take reasonable steps to deliver a resolution within 30 business days. Where this is not possible, we will respond within a reasonable and practical timeframe.
If you are not satisfied with the outcome of your complaint, you may refer the matter to the Office of the Australian Information Commissioner.
10. Notifiable Data Breaches
Align Infrastructure is compliant with the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988. In the event of a data breach likely to result in serious harm to individuals whose personal information is involved, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.
